You hereby waive, release, indemnify, hold harmless, and forever discharge India Fest, the India Association of Memphis, Inc. (“IAM”), and Agricenter International, along with their respective agents, employees, officers, directors, volunteers, trustees, affiliates, successors, and assigns, from any and all claims, demands, actions, liabilities, damages, losses, or expenses of any kind (including, but not limited to, cancellation of India Fest), whether known or unknown, in law or in equity, that you now have or may have in the future, arising out of or related to your participation in any activity or event organized by, conducted at, or undertaken for the benefit of IAM or India Fest.
By agreeing to this Waiver, you expressly assume all risks associated with your participation in India Fest Memphis 2025 and accept full responsibility for any personal injury, illness, property loss, or damage that may occur as a result of your participation. You are also responsible for any damage to the facility, equipment, or premises caused by your actions or those of your representatives during the event. You agree to comply with all applicable rules and regulations set forth by IAM, Agricenter International, and the City of Memphis, including the Memphis Fire Code, Food Safety requirements, and all vendor and booth guidelines.
You also grant permission to IAM and India Fest to photograph, film, or otherwise record your booth or participation, and to use such materials for promotional or public purposes in any lawful format, without compensation or further consent.
You acknowledge that you have carefully read and fully understand the terms of this Waiver and Release. By signing below, you voluntarily relinquish certain legal rights, including the right to bring future claims against IAM, Agricenter, or their representatives. You affirm that you are entering into this Agreement freely, without duress or coercion, and that you are at least eighteen (18) years of age and legally competent to execute this Waiver. Your signature below confirms your full and unconditional acceptance of this Waiver and Release of Liability, to the maximum extent permitted by law.
IMPORTANT: We strongly recommend that you obtain and carry General Liability Insurance to cover any claims related to bodily injury or property damage that may occur during your participation at India Fest Memphis 2025.
Please note that the waiver you sign at check-in releases India Fest event organizers, the India Association of Memphis (IAM), and all associated entities from any liability for such claims.
